N2  - El presente trabajo investigativo tiene como finalidad establecer el alcance jurídico de la responsabilidad del delegatario según sentencias judiciales, para lograr el objetivo me he planteado primeramente la conceptualización de la delegación administrativa y responsabilidad solidaria, seguidamente se establecerá el régimen constitucional y legal de la delegación en el marco jurídico colombiano, y finalmente se establecerá la sentencia es más relevantes de la corte constitucional y el Consejo de Estado sobre la responsabilidad del delegatario dentro del ordenamiento jurídico colombiano. Así las cosas, este análisis busca ahondar sobre la figura de la delegación y así como la responsabilidad patrimonial del delegatario para poder definir hasta qué punto le corresponde a este responder cuando le son otorgados facultades o potestades por parte del delegante. Sin embargo, mediante este análisis igualmente se hace un señalamiento sobre la responsabilidad del incumplimiento de deberes de inspección y cuidado a los actos que realice el delegatario en la actividad pre contractual y contractual del Estado; The purpose of this investigative work is to establish the legal scope of the responsibility of the delegatee according to judicial sentences, to achieve the objective we have first considered the conceptualization of the administrative delegation and joint liability, then the constitutional and legal regime of the delegation will be established in the Colombian legal framework, and finally the most relevant sentence of the Constitutional Court and the Council of State on the responsibility of the delegatee within the Colombian legal system will be established. Thus, this analysis seeks to delve into the figure of the delegation and also the patrimonial responsibility of the delegatee in order to define to what extent it corresponds to this respond when they are granted faculties or powers by the delegator. However, through this analysis, an indication is also made about the responsibility of the breach of duties of control and surveillance to the acts carried out by the delegatee in the pre-contractual and contractual activity of the State
