El presente trabajo se encuentra enfatizado en conceptualizar los aspectos sustanciales del Sistema de Seguridad Social en Salud en Colombia, los antecedentes existentes desde el punto de vista procesal, la normatividad del derecho fundamental a la salud y su goce efectivo, descendiendo desde las normas constitucionales hasta las legales. Este énfasis cala con exactitud en las cotizaciones a salud que de manera obligatoria deben realizarse al régimen contributivo pues se procura obtener el pago de las mismas ante el incumplimiento por parte del empleador, observándose una violación sistemática del derecho fundamental a la salud con la no afiliación por parte de los empleadores ante la existencia de una relación laboral al cohibirse de sus deberes legales. En segundo lugar, ponemos de presente las situaciones que versan frente al destino de los aportes a salud en las decisiones de la Sala de Casación Laboral de la Corte Suprema de Justicia, así como las posturas de estos falladores y las afectaciones que estas conllevan en las partes integrantes del litigio (Demandante – Demandado), así como la existencia de la prescripción de la acción procesal laboral con atención a estos aportes. Por ello, se tiene una investigación jurídica, con un enfoque cualitativo teniendo de presente fuentes secundarias como son la doctrinaria, la constitucional y la legal. En conclusión, se aclara en qué casos se ordena el pago de los aportes a salud. |

The present work is emphasized in conceptualizing the substantial aspects of the Social Security System in Health in Colombia, the existing antecedents from the procedural point of view, the regulations of the fundamental right to health and its effective enjoyment, descending from the constitutional norms to the legal ones. This emphasis permeates exactly in the health contributions that must be compulsorily made to the contributory regime since it is sought to obtain their payment in the event of non-compliance by the employer, observing a systematic violation of the fundamental right to health with non-affiliation. by employers in the presence of an employment relationship by refraining from their legal duties. Secondly, we present the situations that deal with the destination of contributions to health in the decisions of the Labor Cassation Chamber of the Supreme Court of Justice, as well as the positions of these adjudicators and the effects that these entail in the integral parts of the litigation (Plaintiff – Respondent), as well as the existence of the prescription of the labor procedural action with attention to these contributions. For this reason, there is a legal investigation, with a qualitative approach, keeping in mind secondary sources such as doctrinal, constitutional and legal. In conclusion, it is clarified in which cases the payment of health contributions is ordered |
